 "Kemah Ordinance will ban smoking in most public
places"
I am pleased to share with you that the Kemah City Council passed an ordinance partially banning smoking in most enclosed public places on its first reading.  The ordinance is very similar to the one passed recently by the City of Houston.  There was a significant debate with respect to whether the ordinance should be more restrictive.  In particular, the ordinance continues to allow smoking in restaurant bars and there was a sentiment on Council that perhaps this too should have been banned.  In final analysis, Council felt that uniformity across the area was important and opted to follow Houston's lead.  Like Houston, the Kemah ordinance provides that the smoking ban will be reviewed in 18 months to see how it is working and whether a more restrictive ban should be considered.

I am very proud of Council in taking this leadership role.  Many other cities are considering what they will do in reaction to Houston's ban and I believe will be affected by Kemah's action.

Kemah, TX  To Consider Smoking Ban
HOUSTON -- Weeks after the city of Houston passed a controversial no smoking ordinance, the city of Kemah is now considering doing the same. The City of Kemah's plan will intentionally resemble Houston's recently adopted legislation.

Airman Jones was assigned to the induction center, where he advised new recruits about their government benefits, especially their GI insurance.

It wasn't long before Captain Smith noticed that Airman Jones was having a staggeringly high success-rate, selling insurance to nearly 100% of the recruits he advised. Rather than asking him about this, the Captain stood at the back of the room and listened to Jones' sales pitch.

Jones explained the basics of GI Insurance to the new recruits, and then said, "If you are killed in a battle and have a GI Insurance, the government has to pay $200,000 to your beneficiaries. But, if you don't have a GI insurance and get killed in the battle, the government only has to pay a maximum of $6000."

"Now," he concluded, "which group do YOU think they are going to send into battle first?"

Dear Kemah Resident,

On May 7, the Kemah City Council will ask your opinion on how to pay for street maintenance. Specifically, they will ask if half of the Kemah Community Development Corporation revenues should be diverted directly to the City budget. The Board of the KCDC urges you to vote against this proposition.

The KCDC was created by the voters of Kemah to encourage the economic development of the City, to create jobs and to provide parks and park facilities to the residents.  To that end, the voters approved a one-half cent sales tax to be collected by Kemah businesses.

Street maintenance is crucial to our city and the KCDC intends to help with this process. The KCDC five-year plan includes some street improvements to be considered by the Board. However, street maintenance will not boost tourism and the sales tax revenue and jobs that tourism creates. There are better ways to fund the street maintenance program than taking half of the KCDC funds.

In years since that election, the KCDC has accomplished many projects. It assisted with paying for the Community Center for the residents, the relocation of City Hall, the upgrade of streets, and the installation of sidewalks and decorative lighting in the commercial district. The KCDC paid for the Welcome to Kemah sign at SH 146, the landscaping of SH146, the acquisition and construction of the West Kemah park, the public restrooms at 6th and Kipp, the Kemah.net website, and the Kemah Visitor Center. The KCDC funded the advertising of Kemah in numerous publications and trade shows, the 6th street Lighthouse, and the Archway at Bradford & 6th.  The KCDC budget also sponsored activities such as “Christmas in Kemah,” the 4th of July parade, “Blessing of the Fleet,” and the Kemah car show 

This year, KCDC has budgeted one-half million dollars for the acquisition and development of a fifty-acre park near Kemah Oaks.  Also, KCDC has allocated funds to pave the City parking lot and fund a unique lighthouse façade for the new water tower to be constructed by WCID #12. Progress in preserving and enhancing the character of Kemah has been accomplished over the past few years, but the Board of the KCDC recognizes that much remains to be done.

KCDC’s only debt is the approximate one million dollar note ($10,000 per mo. for 15 yrs.), which enabled the City to proceed with the new Community Center for the residents of Kemah and the purchase of the remaining lots to complete the City Parking Lot. Other than this note, KCDC funds projects by first accumulating revenue annually until there are sufficient monies to complete a project. As an example, the Kemah Oaks park project was delayed until KCDC had sufficient funds to submit an application to the State for a matching grant to pay for this one million dollar project.

Currently, one-third to one-half of the revenues received by KCDC annually is allocated to fixed or ongoing expenses.  These include administrative overhead costs paid to the City, debt service as described above, memberships, promotional expenses and maintenance costs associated with the public restrooms and landscaping.  As a result of ongoing expenses, it will be necessary to delay some projects until sufficient funds have been accumulated to complete them.  If this proposition passes and half of the KCDC funds are taken for street maintenance, these projects will be delayed for many years.

The next major project envisioned by the Board, discussed at a public hearing held last year, is the recreation in some way of the Bathhouse and Bathing Pier that existed in Kemah in the 1920’s.  This will be used by the residents who don’t have direct access to the waters of Galveston Bay. Other projects that directly benefit the citizens of Kemah are under consideration.

The KCDC recognizes that tourism is the City’s major industry.  The City’s size and location militate against major industrial development, large regional offices and large medical facilities. But, the City’s size and location adjacent to Galveston Bay make it an ideal destination for visitors from the Houston metropolitan area and beyond.  Kemah’s asset as a water front location can be thoughtfully developed for the benefit of all Kemah residents.

These projects are funded by sales taxes paid primarily by visitors to our community. If we can continue to construct projects, which increase tourism and visitors, then sales tax revenues will increase and the City can keep property taxes low.

The ultimate objective of KCDC – to develop community projects, which encourage new business and attractions resulting in the drawing of more visitors who will spend money in Kemah. Remember: the primary sources of revenue (approximately 66%) for the City’s budget are sales and beverage taxes. Increasing this revenue is the best long term way to pay for Kemah streets and infrastructure.

Kemah voters exercised vision and great foresight when they created the KCDC. The present Board of the KCDC is committed to continuing to implement that vision.  The KCDC is proud to represent the interests of all of the residents of Kemah and looks forward to continuing its partnership with the City Council to achieve their goals.

We believe that the KCDC should be a catalyst for positive growth, not just another source of revenue for the City.  Again, we ask you to please vote against this proposition.

FOR KEMAH BALLOT PROPOSITION 1

Kemah City Council voted to hold a referendum on the use of KCDC funds in conjunction with the regular City elections in May.  The referendum will be on whether half of the KCDC's revenue should be used for street maintenance and construction.  As I have previously shared with you, between the KCDC funds and the City's hotel/motel tax, there is currently over $850,000 available annually.  In my opinion, we do not need to be spending that much money on economic development and promotion.  The City is already growing so fast we can barely manage it.  The pressing need is for infrastructure improvements to our streets and drainage.  Reallocating $300,000 of this $850,000 is the least we can do for the residents.

I hope that you join me on May 7 in voting FOR Proposition 1 and encourage your family and neighbors to do the same.

Hurricane plan urges mandatory evacuation

Bill King, the outgoing Kemah mayor and a friend of Perry's, was one of a group of local officials who fretted that Texas was unprepared for a catastrophic storm. King said Thursday that McCraw's report is a solid first step to preparing for the inevitable.


"I'm ecstatic," King said. "They've adopted almost every recommendation we've made. I think we're making a little headway now. He's shown us the way. Now we have to roll up our sleeves and get it done."

Bayou Vista, League City and Friendswood have adopted the appraisal cap resolutions. 

Galveston County Commissioners will vote Monday, 9 am.  PLEASE PLAN TO ATTEND AND LET THEM KNOW THIS IS IMPORTANT TO YOU!  Bottom line--we don't want excuses, we want accountability, leaner government, and less taxes!

Tiki Island will vote Tuesday.  Efforts are underway in Clear Lake Shores and Dickinson but your help is needed to get our elected officials to take a stand--tax relief or higher taxes??

This is real money--your money--that is being debated in city halls, county courthouses, and the Capital in Austin.

The resolution on a 3% cap  needed to be placed on the agenda by a Commissioner - that Commissioner Ken Clark was the one and only Commissioner who placed the resolution  on the agenda last week when Pat Doyle was not present  and the resolution was removed, it was once again Commissioner Ken Clark who immediately the next day placed the 3% cap resolution BACK on the agenda for Monday.  No one else did it - not Doyle, not Yarbrough. If you feel strongly abot this be at the The regular Monday meeting is held at the Ray Holbrook County Building, 601 Tremont in the Commissioners' Court meeting room on the first floor. The meeting starts at 9:00 am, but check the posted agenda for adjustments to the time.Ken.Clark@co.galveston.tx.us

"TML says that Galveston County Tax Assessor Collector Cheryl Johnson used FLAWED formulas and useless statistics to compute the average appraised value of homes in Friendswood.  The local paper Galveston Daily News ran a story telling the TML side of the story and trying to ease the intense political pressure on the local officials who were endorsing higher taxes while their appraisals mysteriously didn't increase.  It didn't work.

Now we find that TML didn't do its homework - Ms. Johnson used the exact formula prescribed in the Texas "Truth In Taxation" law - in effect for over 8 years.  That's right - the formula is State Law - not something you can interpret or "adjust to your benefit".  Do you think this would keep TML from posting this on their web site?  Not a chance - because TML isn't interested in the truth or what's good for the taxpayer - they are only interested in what's good for the TAXMAN!  And when they don't get their way - they resort to namecalling!  Tsk tsk - it's sad really."

The Friendswood City Council passed a resolution yesterday to support a reduction in the residential appraisal cap to 3%. The measure passed with a vote of 5-1, with Councilwoman Laura Ewing voting no.

The final resolution read as follows: "Building upon our reputation of fiscal responsibility and commitment to reducing the property tax burden on resident homeowners, support the governor's legislative program to bring equality to the property tax system through reduced property tax appraisals for residential properties from 10 percent to 3 percent."

Three weeks ago, City Manager Ron Cox testified before the House Ways and Means Committee that lowering the appraisal cap had grave consequences for Friendswood and that the system was not broken and did not need fixing. In a letter to the committee, Mr. Cox stated, "The City of Friendswood is very disturbed and disheartened by current proposals that seek to artificially cap appraised values."

After testifying before the committee in Austin, KSEV and CLOUT found that Mr. Cox and other members of the Friendswood City Council have not experienced skyrocketing home appraisals like the rest of Friendswood.

We are very glad to see that the Council has changed its mind and hope to see one or all of them back in Austin to correct their statement to the House Ways and Means Committee.

Bayou Vista and League City have both passed resolutions to support the Governor's plan for property tax relief!

Tuesday, the League City Council voted in favor of a resolution to support lowering the appraisal cap on residences and the Bayou Vista City Council has done the same.

The lobbyists of the Texas Municipal League, which actively lobby against tax payers on our dollar, are losing their stranglehold on TML members.  Free speech among Texas cities will prevail!

We think it's a great idea for fiscally responsible cities to cancel their membership to TML and formulate their policies based on their residents needs, not talking points from Lobbyists in Austin.


City of Pearland receives rave review by citizen Lobby group CLOUT

CLOUT  recently learned of some dirty TML tactics to strongarm its members into compliance with its out of touch policies. 

TML has an arm called the Texas City Manager's Association (TCMA) with recently passed a resolution requiring TML's paid lobbyists to notify the city manager in writing if a city employee comes to Austin to testify against an official TML position.  Wasn't this on the last episode of the Sopranos?  Obviously, the fear of disciplinary action for fiscally responsible elected officials would be a deterrant to testifying against TML.  CLOUT will forward these documents to the Texas Attorney General for his review, and encourages any municipal employee or appointed official who has suffered threats or intimidation as a result of their testimony in Austin to contact us; complete confidentiality is assured.
